Here are Marcia's suggestions for New Year's Eve 2008:

For the heavy-pockets crowd: The Dining Room at the Ritz-Carlton’s chef Ron Siegel has put together a seven-course tasting menu ($500 per adult, inclusive of wine pairing, tax, and gratuity). Guests will enjoy a live band and dancing until 2am. Seating times: 7pm to 9pm.

For the less-than-spectacularly loaded: Fifth Floor is hosting two different seatings, one from 5:30–6:30pm (four-course menu with wine pairings: $125, or $175 premium wine pairings, not inclusive of 20% service charge); or from 8:30pm–9:30pm, (five-courses with wine pairings: $150, or $200 premium wine pairings, not inclusive of 20% service charge).

For the Francophile on a budget: Rue Saint Jacques has a charming atmosphere, with the cable car running right by the restaurant. The New Year’s menu includes a duo of foie gras, black truffle “cappuccino,” seared scallops, venison, and a chocolate dessert. The six-course menu is $65, the wine pairing is $45.

For the gourmand: Bar Tartine is doing two prix-fixe menus, one for omnivores, and another equally decadent spread for vegetarians, each highlighting a little luxury (caviar, truffles, spiny lobster, and more…). A complimentary house-made prosecco aperitif kicks off the evening, and for diners counting down to 2009 at the table, a glass of Champagne. $80 four-course prix-fixe menu ($120 with wine pairings). Seatings from 6:30pm–10:30pm.

For the fireworks set: One Market Restaurant will feature two seatings with a special four-course menu from chef Mark Dommen. Live piano music from Billy Philadelphia, and diners for the second seating will have spectacular views of the fireworks from Pier 36, as well as a midnight toast with complimentary Iron Horse One Market Cuvée. The first seating begins at 6pm. ($85 per person), and the second seating begins at 8pm ($120 per person).

For the romantic: Baraka is hosting a 7pm seating with a three-course prix-fixe dinner for $75, and a 9:30pm seating with a three-course prix-fixe dinner with an extra amuse, a glass of Champagne, and party favors for $95. There will be an optional wine pairing for an additional $40 for either seating. Entrée selections will include slow-rendered duck breast, braised leg, turnip puree, quince, and cinnamon duck jus; or seared scallops, bacon, sunchoke puree, crispy artichoke, chervil, and roasted chicken jus.

A San Francisco favorite: Piperade is offering a four-course prix-fixe menu for $100 (excluding tax and gratuity), with seatings from 5:30pm–10:30pm. Complimentary glass of cava for all diners. Entrée choices include roasted squab with root vegetables and huckleberry sauce; fillet of beef with Gascon fries and sauce Choron; sautéed black cod with porcinis and Irouléguy reduction; or chicken “duet” coated with pistachio-dried apricots, shiitake, and sherry wine jus.

For the wine lover: Maybe you don’t want to do a sit-down dinner? The sleek and spacious Press Club will be hosting an all-inclusive New Year’s Eve extravaganza to celebrate the times. Tickets include wine, beer, food, and a Champagne toast. Tickets are $125 in advance, $150 at the door and can be purchased by calling Press Club at . Doors open at 9pm.

For the stock broker (hired or fired): Palio D’Asti is hosting a choice of New Year’s meals, whether you are on a Bear’s or Bull’s budget. For the Bears, Palio will be offering a three-course dinner including a complimentary glass of prosecco, antipasti (appetizer), primo (main pasta/risotto course), and a full dessert buffet priced at $39 per person. The Bulls can add a second main course (second/meat or seafood) for an additional $9 ($48 per person). There are four Italian-American menu options: The Sicilian Seafood Dinner, The Northern Italian Plains Dinner, The Brooklyn Menu, and The San Francisco (vegetarian) menu. And since Palio is located in the Financial District, it’s within walking distance (four blocks) to the fireworks show on the Embarcadero.

For the Dungeness and bubbles fan, and/or bargain hunter: This deal is pretty hard to beat: Scoma’s in Fisherman’s Wharf is serving a three-course meal for $35 (including local Dungeness crab), with 50% off bottles and half bottles of Champagne and sparkling wine from the wine list (limit one bottle per two entrees ordered so that everyone makes it home safely, and Dom Perignon not included). And to top it all off, there is complimentary valet parking!

Transportation and Parking: Holiday Carpool Validation Program

Muni travel is free from 8:00 pm New Year's Eve until 6:00 am New Year's Day. Other Bay Area public transit agencies offering free or special service include:

Caltrain is operating on a weekday schedule. Additional trains have been added early New Year's Day at 1:00 a.m., 1:45 a.m. and 2:15 a.m.

BART is providing additional service; stations will remain open until approximately 4:00 a.m. New Year's Day.

AC Transit provides regular overnight service on Route 800 from selected stops on Market Street.

SamTrans provides regular overnight service on Route 397 from Transbay Terminal and from 11th & Market.

Golden Gate Transit provides a regular late night Route 70 trip after midnight.

Now, Get Federal Tax Liens Removed - Here's How:

The Internal Revenue Service today announced an expedited process that will make it easier for financially distressed homeowners to avoid having a federal tax lien block refinancing of mortgages or the sale of a home.

If taxpayers are looking to refinance or sell a home and there is a federal tax lien filed, there are options. Taxpayers or their representatives, such as their lenders, may request that the IRS make a tax lien secondary to the lien by the lending institution that is refinancing or restructuring a loan. Taxpayers or their representatives may request that the IRS discharge its claim if the home is being sold for less than the amount of the mortgage lien under certain circumstances.

The process to request a discharge or a subordination of a tax lien takes approximately 30 days after the submission of the completed application, but the IRS will work to speed those requests in wake of the economic downturn.

“We don’t want the IRS to be a barrier to people saving or selling their homes. We want to raise awareness of these lien options and to speed our decision-making process so people can refinance their mortgages or sell their homes,” said Doug Shulman, IRS commissioner.

“We realize these are difficult times for many Americans,” Shulman said. “We will ensure we have the resources in place to resolve these issues quickly and homeowners can complete their transactions.”

Filing a Notice of Federal Tax Lien is a formal process by which the government makes a legal claim to property as security or payment for a tax debt. It serves as a public notice to other creditors that the government has a claim on the property.

In some cases, a federal tax lien can be made secondary to another lien, such as a lending institution’s, if the IRS determines that taking a secondary position ultimately will help with collection of the tax debt. That process is called subordination. Taxpayers or their representatives may apply for a subordination of a federal tax lien if they are refinancing or restructuring their mortgage. Without lien subordination, taxpayers may be unable to borrow funds or reduce their payments. Lending institutions generally want their lien to have priority on the home being used as collateral.

To apply for a certificate of lien subordination, people must follow directions in Publication 784, How to Prepare an Application for a Certificate of Subordination of a Federal Tax Lien. Again, there is no form but there must be a typed letter of request and certain documentation. The request should be mailed to one of 40 Collection Advisory Groups nationwide. See Publication 4235, Collection Advisory Group Addresses, for address information.

Taxpayers or their representatives may apply for a certificate of discharge of a tax lien if they are giving up ownership of the property, such as selling the property, at an amount less than the mortgage lien if the mortgage lien is senior to the tax lien. The IRS may also issue a certificate of discharge in other circumstances if the taxpayer has sufficient equity in other assets, can substitute other assets, or is able to pay the IRS its equity in the property. Without a tax lien discharge, the taxpayer may be unable to complete the home ownership change and the ownership title will remain clouded.

To apply for a tax lien discharge, applicants must follow directions in Publication 783, Instructions on How to Apply for a Certificate of Discharge of a Federal Tax Lien. There is no form but there must be a typed letter of request and certain documentation. The request should be mailed to one of 40 Collection Advisory Groups nationwide. See Publication 4235 for address information.

The IRS also urges people to contact the agency’s Collection Advisory Group early in the home sale or refinancing process so that it can begin work on their requests. People sometimes delay informing lenders of the tax liens, which only serves to delay the transaction.

Currently, there are more than 1 million federal tax liens outstanding tied to both real and personal property. The IRS issues more than 600,000 federal tax lien notices annually.

Coast Guard Report on Buona Madre - Eva Danielsen Collision off Point Reyes


On July 13, 2007, in heavy fog off Point Reyes, the Buona Madre, a 28-foot fishing boat out of Santa Cruz, collided with the 291-foot cargo ship Eva Danielsen.

A U. S. Coast Guard investigation reports that communication failures may have resulted in a fatal delay of a full-scale search and rescue.

Mortgage Forgiveness Relief for California Homeowners Available Now!


The California mortgage forgiveness debt relief law (Senate Bill 1055), was enacted after many taxpayers had already filed their 2007 tax return, but covers qualified debt forgiven in 2007 and 2008.

The California mortgage forgiveness debt relief law is similar to federal law, but with important differences.

The California law covers qualified debt forgiven in 2007 and 2008, and it:

- Limits the amount of qualified principal residence indebtedness to $800,000 for taxpayers who file as married/registered domestic partners (RDP) filing jointly, single, head of household, or widow/widower, and to $400,000 for taxpayers who file as married/RDP filing separately.

- Limits debt relief to $250,000 for taxpayers who file as married/RDP filing jointly, single, head of household, or widow/widower, and to $125,000 for taxpayers who file as married/RDP filing separately.


The federal law covers qualified debt forgiven from 2007 through 2012, [1] and it:

- Limits the amount of qualified principal residence indebtedness to $2 million for taxpayers who file as married filing jointly, single, head of household, or widow/widower, and to $1 million for taxpayers who file as married filing separately.


- Does not limit the debt relief amount: it only limits the indebtedness amount used to calculate the debt relief amount.

If you filed your 2007 tax return before October 2008, or you were unaware of this new law, you may have overpaid your 2007 taxes.

If you overpaid your taxes, there is a time statute of limitations [2] to request a refund from us. Generally, you can file a refund claim until the later of four years from the due date of the return or one year from the date of overpayment.

If you want to file a claim for refund in order to claim debt relief, you can file a Form 540X, Amended Individual Income Tax Return.

If the amount of debt relief for federal purposes is more than the California limit, include the amount in excess of the California limit on Schedule CA (540/540NR) line 21f, Column (C).

If the amount of debt relief for federal purposes is the same as the California limit, no adjustment is necessary on Schedule CA (540/540NR). On Form 540X, simply enter on line 2e, Column (B), the amount originally entered on Schedule CA (540/540NR) line 21f, Column (C).

SFPD Warning to Holiday Shoppers and Visitors

Beware of shoplifters, purse thieves, snatch-and-run shopping bag thefts and auto break-ins. Please read this warning from the San Francisco Police Department:

San Francisco visitors and shoppers can be pro-active in helping to ensure safety by heeding some personal safety tips:

 

  • Always be alert to your surroundings.  Be wary of a stranger deliberately approaching you or following you to your car.  Have your keys in your hand as you approach your vehicle or home so there is no delay in getting inside. 
  • Do not overburden yourself with packages.
  • Shop with a family member or friend, especially after dark.
  • Keep wallets in a hard-to-reach place.  Be wary of anyone causing a distraction in close-quartered places, such as on public transit.
  • Carry only the cash and credit cards that you will need.  Keep cash separate from ID and credit cards, and do not carry your passport or social security card.
  • If someone demands your purse or wallet, surrender it.  Resisting may result in bodily harm.  Immediately report anything stolen to police.
  • Help avoid vehicle break-ins.  Leave nothing visible in your car, including GPS devices and other electronic devices. Remove the GPS cradle as well.  Keep packages locked in your trunk while shopping and move your vehicle to a different location each time you load packages. Try to park in a lot where there is an attendant.

Eric Siu Wanted by SFPD in Double Murder

On March 29, 2008, at approximately 2:17 a.m., a double homicide occurred in front of a restaurant located on Irving Street, near 19th Avenue. The San Francisco Police Department is asking for the public’s help in locating Eric Siu, a person of interest in this investigation.

Eric Siu is described as a Chinese male, 20 years old, 5’ 08”, and 135 lbs. He has short black hair, brown eyes, and has a medium complexion. Eric Siu was last seen in the area of 19th and Irving Street, on March 29th 2008. At the time of the incident he was a San Francisco resident, and lived in the Sunset District.

Anyone with any knowledge of Eric Siu’s whereabouts is asked to please contact the San Francisco Police Department tip line at as soon as possible.

The White Robed Monks of St. Benedict at the Interfaith Chapel at the Presidio - Christmas Eve

1) Celebrate the holidays at the Presidio of San Francisco. The Interfaith Center at the Presidio (the old Main Post Chapel when the Army was still at the Presidio) is hosting a remarkable event this Christmas. It will feature the White Robed Monks of St. Benedict.

Everybody, regardless of faith, denomination, religion or anything else that tends to divide people - everybody - is warmly invited to the annual Christmas Eve carol-sing and worship service.

Carol Sing and Christmas Mass at the Chapel will be held on Wednesday, December 24, at 7 pm. Principal celebrants will be the White Robed Monks of St. Benedict.

Refreshments will be offered after the service.

The White Robed Monks of St. Benedict have a spiritual outlook is that is catholic (experience: love/compassion) rather than Catholic (belief: fear, guilt, shame, blame). Thus, they are neither Roman nor Orthodox, Liberal nor Old Catholic.

The definition of "catholic" is: 1. Of broad or liberal scope; comprehensive: “The 100-odd pages of formulas and constants are surely the most catholic to be found” (Scientific American). 2. Including or concerning all humankind; universal: “what was of catholic rather than national interest” (J.A. Froude).

To understand the White Robed Monks of St. Benedict requires not only a familiarity with western Christian monasticism, but with Buddhist monasticism as well.

The Dreaming of a Green Christmas program uses trees that are well suited for San Francisco's environment. Instead of being used once and then destroyed, these trees become a permanent part of our beautiful City.

Volunteers needed on Sunday, December 7. We need folks to help load and move trees from the Presidio to Civic Center, where we will be setting up our Christmas tree lot.

Volunteers must be able to lift 20 pounds and be eager to engage participants about this wonderful program. Hot cocoa will be served to keep everybody warm!

Obama and Daschle Want Your Thoughts on Health Care - Email Link Here


Transparency and engagement are priorities for the Obama-Biden Transition Project. Our success depends on not only opening up a process that has historically been inaccessible to most Americans, but also encouraging citizen participation.

Last week, President-elect Obama and Vice president-elect Biden took an important step towards these goals by asking the public to participate in a discussion about health care on our website.

The result was fantastic. Started by a question from the Obama-Biden Health Policy Team, thousands of comments poured in over a few days. Some people answered the initial question, but others engaged with one another debating and developing new ideas and approaches to health care reform.

Members of the Health Policy Team, including former Senator Tom Daschle, read through these comments over Thanksgiving weekend.

A Streetcar Named Desire - see the real streetcar in San Francisco!


On December 3, 1947, Marlon Brando's famous cry of "STELLA!" first boomed across a Broadway stage, electrifying the audience at the Ethel Barrymore Theatre during the first-ever performance of Tennessee Williams' play A Streetcar Named Desire.

San Francisco's MUNI historic streetcar, Car No. 952, came from New Orleans to San Francisco in 1998 by arrangement between Mayors Willie Brown and Marc Morial. The occasion was the world premier of Andre Previn’s opera of Williams’ novel. While the original intention of the mayors was to convey title of No. 952 to San Francisco, Louisiana state historic preservation officials required that the car be leased instead.

Car No. 952 has proved extremely popular with San Franciscans and visitors, bringing a bit of the flavor of the 'Crescent City' to the City by the Bay and serving as an ambassador on wheels for New Orleans, with displays inside the car celebrating streetcars in New Orleans literature.

The 23-year-old Brando played the rough, working-class Polish-American Stanley Kowalski, whose violent clash with Blanche DuBois (played on Broadway by Jessica Tandy), a Southern belle with a dark past, is at the center of Williams' famous drama. Blanche comes to stay with her sister Stella (Kim Hunter), Stanley's wife, at their home in the French Quarter of New Orleans; she and Stanley immediately despise each other. In the climactic scene, Stanley rapes Blanche, causing her to lose her fragile grip on sanity; the play ends with her being led away in a straitjacket.

Asthma Inhalers Banned - New Inhalers Now Available

Last warning: Asthma inhalers go "green" on Dec. 31, forcing patients still using the old-fashioned kind to make a pricey and even confusing switch. The medicine inside these rescue inhalers — the albuterol that quickly opens airways during an asthma attack — isn't changing. But the chemicals used to puff that drug into your lungs are.

No more chlorofluorocarbons, or CFCs, that damage Earth's protective ozone layer. By year's end, all albuterol inhalers must be powered by the more eco-friendly chemical HFA, or hydrofluoroalkane.

The down side: The new inhalers cost more, $30 to $60 compared to as little as $5 or $10 for the disappearing generic CFC inhalers.

And patients face a learning curve. HFA inhalers must be used differently than the old-fashioned kind. The medicine feels and tastes different, sometimes alarming new users despite doctors' assurances that it works just as well.

"There's still significant confusion," says Dr. Harvey Leo of the University of Michigan's C.S. Mott Children's Hospital. "Patients will tell you, 'I don't feel the puff anymore.'"

Calls from parents unsure how to use the new inhalers, or even what they are, have increased in the past two months as more drugstores run out of CFC-powered inhalers and automatically switch people who'd been expecting a mere refill, he adds.

The change shouldn't be a surprise. The Food and Drug Administration has long warned it was coming, and lung specialists have spent the past year easing many of the nation's 20 million asthma patients — as well as millions of emphysema sufferers who also use albuterol to ease breathing — into it.

IRS Announces New Appeals Program for OIC and TFRP Actions


Yesterday the Internal Revenue Service announced a two-year test of two programs: the post-Appeals mediation and arbitration procedures for Offer in Compromise (OIC) and Trust Fund Recovery Penalty (TFRP).

Beginning yesterday, Dec. 1, 2008, for a two-year test period, Appeals will offer post-Appeals mediation and arbitration for OIC and TFRP cases for taxpayers whose appeals are considered at the Appeals office in Atlanta, Ga.; Chicago, Ill.; Cincinnati, Ohio; Houston, Texas; Indianapolis, Ind.; Louisville, Ky.; Phoenix, Ariz.; and here in San Francisco at 450 Golden Gate Avenue.

Under these two alternative dispute resolution programs, the taxpayer or Appeals may request nonbinding mediation. The taxpayer may decline Appeals’ request for mediation. Appeals will evaluate a taxpayer’s request for mediation based on the criteria detailed in Revenue Procedure 2002-44 and Announcement 2008-111. A request for binding arbitration must be made jointly by the taxpayer and Appeals. The mediation and arbitration procedures do not create any additional authority for settlement by Appeals.

During the test period, Appeals employees will advise the taxpayer of the availability of these alternative dispute strategies and the deadline for timely requesting such strategies when a rejection of an OIC is sustained or a proposed TFRP assessment is sustained.

An OIC submitted during Collection Due Process (CDP) as an alternative to a Collection action is not eligible for these alternative dispute resolution strategies during the test period.

The Post-Appeals mediation process is available for both legal and factual issues. The mediator’s role is to facilitate settlement negotiations so the parties can reach their own agreement. The mediator does not have settlement authority over any issue.

The Arbitration procedure is available for factual issues only. The arbitrator’s role is to hear both sides of a disputed issue and then render a decision on the specific factual issue being arbitrated. This decision is binding on both parties. However, the arbitrator does not have the authority to decide that the offer in compromise itself must be accepted or that a person is/is not liable for the TFRP under § 6672. Neither party may appeal the decision of the arbitrator or contest the decision in any judicial proceeding. (Section 6672(a) imposes a penalty against any person required to collect, truthfully account for, and pay over any tax imposed by the Code who willfully fails to collect, or truthfully account for and pay over the tax, or who willfully attempts in any manner to evade or defeat the tax.)

Complete procedures for initiating a request for post-Appeals mediation or arbitration are in Announcement 2008-111.

The agency will seek appropriate Offer in Compromise and Trust Fund Recovery Penalty cases for both post-Appeals mediation and arbitration during the two-year test period in order to evaluate the effectiveness of alternative dispute resolution for these cases.

President-elect Obama's World AIDS Day Video Message 2008

We've come a long way from the "ignorance and fear" that once defined the world's reaction to the HIV/AIDS epidemic, President-elect Obama says in a video message and statement released today to mark the 20th anniversary of World AIDS Day. But he also points out that we still have a long way to go to defeat HIV/AIDS, both here in the United States and globally.

"[I]n the end this epidemic can’t be stopped by government alone, and money alone is not the answer either," he said. "All of us must do our part."

to mark the 20th anniversary of World AIDS Day
December 1st, 2008

World AIDS Day is a day of both commemoration and promise for the many millions of people around the world who are affected by HIV/AIDS. This year’s theme, Leadership, is a particular reminder to me that World AIDS Day cannot be confined to a single day of the year. For that reason, I have committed my administration to developing and implementing a comprehensive National HIV/AIDS Strategy to reduce HIV infections, increase access to treatment and care and reduce HIV/AIDS-related health disparities.

Today, the United States faces an alarming rate of HIV/AIDS infections. Through the National HIV/AIDS Strategy, we will set a series of goals to prevent and reduce HIV/AIDS infections and improve treatment throughout the United States, particularly among communities of color which have been disproportionately affected. I will ensure that the federal government is accountable for achieving these goals.

Too many people are unaware that while HIV/AIDS is incurable, it is 100 percent preventable. And far too many people have become infected because they lack basic information about how this disease is spread. I intend to confront the stigma surrounding HIV/AIDS – a stigma which is too often tied to racism, sexism and homophobia. That is what Michelle and I tried to do by taking a public HIV test in Kenya a few years ago.

We must engage in honest, open dialogue and reach out to those most at risk. My administration will educate people about HIV/AIDS, ensure people living with HIV/AIDS have access to treatment, and work with Congress to enact an extensive program of prevention, including access to comprehensive age-appropriate sex education for all school age children.

We will also keep faith with the millions of people living with HIV/AIDS around the world by continuing to support the work of the Global AIDS Fund and maintaining our strong leadership through the President’s Emergency Plan For AIDS Relief.

And after a year of important work to end HIV/AIDS, World AIDS Day 2009 will offer an opportunity for us to take measure of the progress we have made.

Finally, to all those living with HIV/AIDS in the United States and throughout the world, their families and partners and caregivers, know that I will be keeping you in my thoughts and prayers today and throughout the coming year.
